Ilkari Domains acceptable use policy (“Policy”)

Purpose and benefits

This Acceptable Use Policy (“Policy”) defines the acceptable use Policy for the use of any products and services (‘Services”) offered and provided by Ilkari Domains and its affiliates and or via Ilkari Domains infrastructure and its website(s).  The purpose of this Policy is to ensure the security, reliability, and availability of Ilkari Domains network and infrastructure, as well as to protect the rights and interests of Ilkari Domains and its users. The terms of this Policy are in addition to the terms of the applicable domain Services agreement between customer and Ilkari Domains for the provision of Services (“Agreement”). If there is a conflict between the terms of this Policy, the Website Terms of Use and the Agreement, the Agreement will take precedence. It will not be considered a conflict if this Policy imposes additional requirements beyond those imposed by the Agreement.

Authority

This Policy complies with ISO 27001 and meets the principles and obligations set out by the General Data Protection Regulation (“GDPR”) Legal Framework and any amendment thereof and any other applicable privacy legislation & Free Trade Zone. Regular audits and monitoring will be conducted to ensure compliance and all findings reported.

Scope

This Policy applies to all Ilkari Domains customers, and to any person or entity who uses or obtains access to the Services through an Ilkari Domains customer (“Authorized Users”). Customer and Authorized Users are collectively referred to as “User(s).” Customer must ensure that all Users comply with this Policy. Customer is solely responsible for any material or information that any User maintains, transmits, downloads, views, posts, distributes, or otherwise accesses or makes available using the Services or the Ilkari Domains Site. Without limiting the generality of the foregoing, Customer is responsible for all acts and omissions of its Users. Any breach of this Policy by a User will be considered a breach of this Policy. It is the user’s responsibility to read and understand this Policy and to conduct their activities in accordance with its terms.

Acceptable use

Customers and their Users must refrain from behavior that Ilkari Domains reasonably deems to be inappropriate. Such conduct includes, but is not limited to:

Actions or content that incite targeted activity against specific individuals or groups, or that contain violent or graphic material lacking literary or social value.
Promoting, encouraging, or facilitating human trafficking, including for sexual exploitation.
Disseminating misinformation that is demonstrably false and intended to cause specific harm to targeted individuals or groups.
Engaging in, promoting, or enabling speech that targets, threatens, or encourages violence or harm—physical or psychological—toward others based on characteristics such as race, religion, gender, sexual orientation, or disability.
Engaging in any unlawful activity.

Customers and their Users must not use or attempt to use the Services to store, transmit, or process any material or information that is illegal, harmful, unsolicited, inappropriate, objectionable, or otherwise poses a threat to public safety. This includes, but is not limited to, activities that Ilkari Domains reasonably determines may negatively impact its business, operations, or reputation. Prohibited actions include:

Using the Services in a manner that interferes with or adversely affects the functionality of the Services or other Ilkari Domains customers’ use of the Services.
Generating, distributing, publishing, sending, or facilitating the transmission of unsolicited bulk emails or messages, promotions, advertising, or solicitations (“spam”).
Utilizing the Services to infringe upon any copyright, trademark, patent, trade secret, or other intellectual property rights of third parties.
Engaging in conduct that (a) infringes or misappropriates any proprietary, contractual, or tort rights of others; or (b) violates the privacy, publicity, or other personal rights of individuals or entities.
Using the Services to disseminate, store, advertise, post, display, or otherwise make available material that could reasonably be considered child pornography, obscene, abusive, defamatory, harassing, grossly offensive, vulgar, threatening, or malicious.
Gaining unauthorized access to, disrupting, or interfering with any user, system, network, service, or account belonging to another party, including attempting to compromise the security or integrity of any system or network (e.g., hacking, port scanning, stealth scanning, or similar information-gathering activities).
Distributing, creating, or sending Internet viruses, worms, Trojan horses, conducting pinging, flooding, mailbombing, denial of service attacks, or related activities via the Services.
Exporting encryption software over the Internet or otherwise in violation of European Union or national export control laws.
Participating in any other unlawful activity, including money laundering, illicit advertising, phishing, Ponzi schemes, pyramid schemes, fraudulent sales or charges, and pirating or distributing pirated software.
Engaging in or facilitating acts of terrorism, cyberterrorism, or cyberattacks—including but not limited to activities intended to disrupt, damage, or gain unauthorized access to critical infrastructure, networks, or data for malicious purposes—is strictly prohibited.
Additionally, the use of the Services to participate in, promote, or facilitate gambling activities in any jurisdiction where such conduct is illegal, or in violation of any applicable laws and regulations, is expressly forbidden.

Use of Ilkari Domains site’s Services is subject to this Policy, Terms of Use and terms and conditions of the Agreement.

Monitoring and investigation

Ilkari Domains reserves the right to monitor, investigate, and log any and all use of its Services and network use, including communications or content transmitted through its systems, for the purposes of enforcing this Policy, complying with applicable laws, and protecting the security and integrity of its infrastructure.

Compliance

Generally, we may share information with relevant authorities or third-party vendors as required by law or to investigate abuse reports. Abuse complaints are reviewed and handled in accordance with this Policy, Website Terms of Use and the Agreement. We reserve the right to take appropriate action, including suspending or terminating access to our Services. In addition, if any User violates the terms of this Policy, Website Terms of Service and the Agreement, Ilkari Domains may, in addition to any remedies in the Agreement, take all action necessary to remedy the violation including, but not limited to, suspending or terminating the Services or implementing technical mechanisms to prevent Policy violations without notice and at its sole discretion and based on its own judgement.

Amendments and modifications

We reserve the right to update or modify this Policy at any time. Any such changes will be posted on our website. We encourage you to review this Policy periodically to stay informed about how we are protecting your information. By continuing to use our Services after any such amendments, you agree to the updated terms of this Policy. If you do not agree to any changes, you should discontinue using our Services and contact us to deactivate your account.

Disclaimer and limitation of liability

Ilkari Domains does not guarantee or warrant the availability, performance, security, or reliability of the Services or any network, infrastructure, system, or resource. Ilkari Domains is not responsible or liable for any loss, damage, or harm arising from or relating to the users use of the Services or any network, infrastructure, system, or resource, or from any violation of this Policy by the user or any third party. The user agrees to indemnify, defend, and hold harmless Ilkari Domains and its affiliates, directors, officers, employees, agents, and contractors from and against any and all claims, liabilities, damages, costs, and expenses (including reasonable attorney fees) arising from or relating to the user’s use of the Services or any network, infrastructure, system, or resource, or from any violation of this Policy by the user or any third party.
